Conditions of Use

The following terms of use (hereinafter the "Terms") govern the conditions under which the company Laboratoires Théa (hereinafter the "Company") provides internet users and its customers access to the website www.emyo2026.com (hereinafter the "Site").

By accessing and using the Site, you accept and adhere without limitation to these Terms as a user of the Site (hereinafter the "User").

1. Purpose

These Terms define the terms and conditions that each User must adhere to when browsing the Site and/or accessing their online account (the "Account").

The Site will (i) promote the EMYO 2026 event to all Young Ophthalmologists across Europe. The event will take place in Berlin on July 4 & 5, 2026. The website will be open access for generic and logistical information. Young Ophthalmologists will be able to register and pay for the event on the website and (ii) create an online user account.

2. Duration

These Terms come into effect upon acceptance by the User and remain in force until the deletion of their Account or, if the User does not have an Account, for the duration of each visit to the Site.

3. Account Creation

It is the sole responsibility of the User to ensure they have a terminal and an internet connection that allows them to browse the Site.

Account creation is done by providing the requested information on the Site, which only allows one Account per User. The User sets their Account access codes and fills out their personal profile (full identity, valid email, password, etc.).

The User guarantees that the data provided during the use of the Site or Account creation is accurate and truthful. The User commits to informing the Company promptly in case of any changes to the data provided. The User remains solely responsible for the use of the transmitted data, both by themselves and by any third party to whom they might have transmitted the data, with any use being considered as use of the Site by the User, which the User expressly acknowledges and accepts.

The User guarantees that no data provided to the Company infringes upon the rights of third parties or is contrary to the law, public order, and good morals. The User commits to not impersonating another person or entity, falsifying or hiding their identity.

Upon first login and after each logout, the User must enter their codes. These are strictly personal and confidential. The User is solely responsible for their confidentiality and does not share them with any third party. Any connection to the Site using the User's codes is considered to be made by the User, with the Company's logs and records serving as proof. The Company disclaims any responsibility in case of use of the Account by a third party using the User's codes. Any loss or theft of the codes must be reported without delay by the User.

4. Use of the Site

4.1 Access and Use

The User is prohibited from (i) reproducing any part of the Site, temporarily or permanently, by any means whatsoever, (ii) distributing, disseminating, or making the Site available directly or indirectly to a third party or the public, either free of charge or for a fee, (iii) translating, adapting, arranging, decompiling, or modifying the Site, particularly to create a similar website.

The Site must be used in accordance with its intended purpose and the stipulations of these Terms. Any non-compliant use may result in the closure of the User's Account without notice or compensation, and without prejudice to the damages that the Company may claim, particularly in case of damage to the Site or the Company's brand image.

4.2 Hyperlinks

Creating any hyperlinks to any part of the Site is strictly prohibited without prior written permission from the Company.

The Company is free to refuse this authorization without justification. If the Company grants authorization, it is temporary and may be withdrawn at any time without the obligation of justification.

In any case, any hyperlink must be removed upon the Company's request. Any information accessible via a link to third-party websites is not under the control of the Company, which disclaims all responsibility for their content.

4.3 Account Suspension or Closure

The User is free to terminate their registration by deleting their Account directly on the Site, subject to, if applicable, a closure request to be sent by email to emyo2026@siebert-events.de.

In case of incorrect or incomplete information provided by the User to the Company, breach of the User's obligations under these Terms, fraud, or attempted fraud, the Company reserves the right to suspend all or part of the access to the Site and/or the Account of the offending User immediately without prior notice and without refund or compensation.

The Company may permanently terminate the User's Account after sending an email to the User informing them of the breaches. This termination is without prejudice to any damages that may be claimed for any harm suffered by the Company due to such breaches, with no compensation of any kind being claimable by the User.

5. Site Availability and Maintenance

The Company strives to ensure remote 24-hour electronic provision of the Site via electronic communication services, subject to server maintenance operations or technical hazards inherent to the internet and the resulting access interruptions, which the User expressly acknowledges and accepts.

Therefore, the Company cannot guarantee permanent availability of the Site or permanent access to User Accounts, nor be held responsible for any consequences, whatever they may be, in case of unavailability or slowdown of the Site.

The service provided by the Company does not include providing internet access or public electronic communication services. The Company will inform the User in advance of any maintenance or update operation.

The equipment (computer, software, communication means, etc.) allowing access to the Site is the exclusive responsibility of the User, as are the communication costs incurred by their use.

6. User Obligations

6.1 General Obligations

The User commits not to exchange content:

  • containing blatant or hidden advertising messages, including spam;
  • false, gross, insulting, derogatory, defamatory, offensive, or pornographic messages, or messages featuring nudity or contrary to French law;
  • infringing upon the rights of third parties (including intellectual property rights, privacy rights, and image rights);
  • containing viruses or programs that may affect the functioning of other computers;
  • intended for the dissemination of political, ideological, or religious messages;
  • intended to gather, record, or use personal data of Users without authorization, particularly for commercial purposes;
  • intended to degrade usage conditions, likely to infringe upon the rights and respect of other Users and the purpose of the Site.

The User's Account is strictly personal. The User keeps their password confidential and does not disclose it to any other person. The User regularly changes their password, at least once every six (6) months.

6.2 Prohibited Behaviors

Behaviors violating these Terms are strictly prohibited.

Violation occurs, without limitation, when:

  • the User intentionally provides invalid, misleading, incorrect, or incomplete data;
  • the User opens more than one personal Account;
  • the User deceives or attempts to deceive, particularly by using mechanisms, software, or other scripts related to the use of the Site that may cause disruptions to the Site's functioning;
  • the User attempts or performs reverse engineering, decompiles, modifies, disassembles, and/or intervenes, particularly for maintenance purposes, on applications, software, and computer codes related to the Site;
  • the User attempts to or performs actions to bypass, circumvent, modify, or influence encryption technologies, security measures, or data transmitted, processed, stored, and used by the Site. To this end, the Company reserves the right to monitor the User's use of the Site and may implement tools to detect any fraud attempts or unauthorized activities;
  • the User intentionally causes disruption or malfunction of the Site;
  • the User uses the Site and its services to harm others in any way;
  • the User uses the Site and its services for the benefit of a third party without the Company's consent;
  • the User voluntarily or involuntarily violates French regulations, these Terms, or the Privacy Policy.

7. Protection of Intellectual Property Rights

The content of the Site, including texts, images, and logos, is protected by intellectual property rights and cannot be used, modified, transmitted, or reused without prior written authorization from Laboratoires Théa and only in accordance with these Terms or as specified on the Site. The User commits to immediately report to Laboratoires Théa any case of fraud and/or unauthorized access they become aware of.

Product trademarks, trade names, and logos, designs and models, and more generally, all copyrights and industrial and intellectual property rights belonging to Laboratoires Théa or its affiliates, or to which Laboratoires Théa or its affiliates have usage rights (collectively the "Marks"), appearing on this Site are the Marks of Laboratoires Théa and/or the THEA Group companies. No mention on the Site can be interpreted as granting, directly or indirectly, any license or right to use any Mark appearing on the Site without the prior written authorization of Laboratoires Théa or any third-party holder of said Mark. Your use of the Marks appearing on the Site other than according to these terms and conditions is strictly prohibited. Laboratoires Théa will use all legal means to ensure the protection of its intellectual and industrial property rights, including any civil and/or criminal proceedings.

8. Personal Data

Creating an Account and more generally using the Site involves the collection of personal data by the Company.

9. Liability

The operation of the Site is offered under a best-effort obligation.

The User acknowledges that the characteristics and constraints of the internet do not allow for guaranteeing the security, availability, and integrity of data transmissions during their transit on the internet.

The User is solely responsible for the terminals and connections necessary for using the Site. It is up to each User to take all appropriate measures to protect their own data and/or software stored on their computer equipment, as well as their codes, against any infringement.

Under these conditions, the Company is not responsible for malfunction, inability to access, or poor conditions of use of the Site attributable to unsuitable equipment, internal malfunctions at the User's internet provider, network congestion, or any other reasons outside the Company.

Disclosing certain illegal content (e.g., photographs, videos, comments) by the User within the Site's use may engage their criminal and civil liability. To this end, the User guarantees the Company against any administrative, criminal, or civil proceedings and any extrajudicial dispute based on such content exchanges initiated by the User, even partially.

The Company's failure to enforce any provision of these Terms should not be interpreted as a waiver of its right to enforce it in the future.

Moreover, neither Party can be held liable for any loss or damage originating from delay or non-performance of its obligations under the Terms due to a force majeure event or fortuitous event as defined by article 1218 of the Civil Code and jurisprudence, provided that the occurrence of this event is promptly notified to the other Party in writing, specifying the impact on the estimated duration during which it will affect the performance of these Terms. Expressly considered as force majeure events are those usually retained by applicable jurisprudence.

In case of dispute, the Company may validly administer as evidence the Site's connection and transmission logs, which alone serve as proof, as the User acknowledges.

10. Termination

The User may delete their Account at any time by simply informing the User.

In any case, in case of breach by the User of these Terms, the Company reserves the right to suspend and/or terminate their Account without notice or compensation of any kind, and without prejudice to any amounts that the Company may claim as damages. Furthermore, as a host of the content that the User may upload via the Site, the Company reserves the right to delete any content that violates applicable laws and regulations under the same conditions.

11. Amendment of the Terms

The Company may amend the Terms at any time. The User will be informed of these changes by any means before their effective date. The changes to these Terms are binding upon acceptance by the User. If the User does not wish to continue using the Site in light of the updated Terms, they must close their Account without compensation.

If one or more provisions of the Terms are declared null and void pursuant to a law, regulation, or final decision of a competent court, the other provisions will retain their full force and scope.

The Terms are accessible at any time upon request and will prevail over any other contradictory document.

12. Governing Law

The Terms are governed by French law. ANY DISPUTE RELATING TO THE TERMS THAT CANNOT BE RESOLVED AMICABLY BETWEEN THE COMPANY AND THE USER WILL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COMPETENT COURTS OF PARIS, FRANCE.
